Coaching Agreement
Purpose and Scope
The purpose of this Agreement is to outline the terms and conditions of the coaching relationship between the Coach and the Client.
Definitions
· Coaching: A thought-provoking and creative process that inspires the Client to maximize their personal and professional potential while reaching specific goals.
· Coach: The individual providing professional coaching services.
· Client: The individual or organization receiving coaching services.
The focus of this coaching engagement centers specifically on habit coaching and mental performance coaching. Through tailored strategies, the Coach supports the Client in building sustainable, positive habits and optimizing mental skills that drive lasting personal and professional transformation. This targeted approach empowers the Client to develop routines, mindsets, and performance-enhancing behaviors aligned with their most important goals.
Coaching Process and Structure
· Sessions: Coaching sessions will be held regularly, based on the package chosen by the client.
· Method: Sessions may be conducted in person or electronically.
· Preparation: The Client agrees to arrive at each session on time, prepared with topics, challenges, or questions to discuss.
· Duration: The length of each coaching session is maximum 60 minutes.
Roles and Responsibilities
Coach’s Responsibilities
· Maintain the highest standards of ethical conduct.
· Provide a safe, supportive, and non-judgmental environment for the Client.
· Listen actively and ask powerful questions to encourage insight, self-discovery, and growth.
· Maintain confidentiality in accordance with this Agreement.
· Support the Client in formulating and pursuing meaningful goals.
Client’s Responsibilities
· Participate fully in all coaching sessions and complete agreed-upon actions between sessions.
· Take responsibility for making decisions and taking action on personal and professional matters.
· Communicate openly, honestly, and promptly about progress and obstacles.
· Respect the Coach’s time and notify in advance of any need to cancel or reschedule sessions.
Confidentiality
Any information discussed or revealed in the course of coaching will remain strictly confidential, except where otherwise required by law (e.g., risk of harm to self or others, legal proceedings) or where both parties agree in writing to share information. The Coach will not disclose the Client’s name as a reference without prior written consent.
The coaching relationship, as well as all information (documented or verbal) that the Client shares with the Coach as part of the relationship, is bound by the principles of confidentiality. However, please be aware that the Coach-Client relationship is not considered a legally confidential relationship (like the medical and legal professions) and thus communications are not subject to the protection of any legally recognized privilege. The Coach agrees not to disclose any information pertaining to the Client without the Client’s written consent. The Coach will not disclose the Client’s name as a reference without the Client’s consent.
Confidential Information does not include information that: (a) was in the Coach’s possession prior to its being furnished by the Client; (b) is generally known to the public or in the Client’s industry; (c) is obtained by the Coach from a third party, without breach of any obligation to the Client; (d) is independently developed by the Coach without use of or reference to the Client’s .court order to disclose; (f) is disclosed to the Coach and as a result of such disclosure the Coach reasonably believes there to be an imminent or likely risk of danger or harm to the Client or others; and (g) involves illegal activity. The Client also acknowledges his or her continuing obligation to raise any confidentiality questions or concerns with the Coach in a timely manner.
Fees, Payment, and Scheduling
· Fees: The coaching fee reflects the price of the package chosen by the Client.
· Payment: Payment must be made in full before the first session, either via the payment link provided by the Coach or by bank transfer to the designated account.
· Rescheduling: Cancellations must be made at least 24 hours in advance. Late cancellations or missed sessions may be billed in full/counted as used sessions, unless otherwise agreed.
· Refunds: In case of termination, the unused portion of the fee will be refunded proportionally, provided the client notifies the Coach in accordance with the terms outlined in this agreement.
Termination
Either party may terminate this Agreement at any time with written notice. In case of early termination, the unused portion of the prepaid fee will be refunded, provided the client gives proper notice as outlined in this agreement.
If, for any reason, payment has not yet been made for sessions already completed, the client remains responsible for settling those fees.
Limitations and Disclaimer
Client is solely responsible for creating and implementing his/her own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and his/her coaching calls and interactions with the Coach. As such, the Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. Client understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
Client acknowledges that coaching is a comprehensive process that may involve different areas of his or her life, including work, finances, health, relationships, education and recreation. The Client agrees that deciding how to handle these issues, incorporate coaching principles into those areas and implementing choices is exclusively the Client’s responsibility.
Client acknowledges that coaching does not involve the diagnosis or treatment of mental disorders and that coaching is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is the Client’s exclusive responsibility to seek such independent professional guidance as needed.
Conflict Resolution
Should any disputes arise, the Coach and Client agree to communicate in good faith to resolve issues informally. If an informal resolution cannot be reached, both parties may pursue mediation or arbitration as mutually agreed.
Intellectual Property
Any written materials, tools, models, or processes provided by the Coach during the course of coaching remain the intellectual property of the Coach, unless otherwise agreed in writing. The Client may not distribute, reproduce, or share these materials outside of the coaching relationship without express permission.
Final Provisions
These Terms and Conditions are effective as of the date indicated below and may be updated from time to time without prior notice. It is your responsibility to review them periodically. By continuing to use this Website or our services, you accept any revised version.
